What Your Building Permit Requires From a Land Survey

A permit office doesn’t care how nice your house plans look. Before a reviewer stamps anything, they want proof your project sits where you say it sits. That proof comes from a land survey. Skip it, and your permit stalls before it starts.

This is the part of the process most homeowners never expect. You budget for lumber, labor, and inspections. Then a clerk asks for a survey, and the timeline slips. Here’s what that survey actually needs to show, and why counties across Arkansas won’t move forward without it.

Why Arkansas Building Departments Won’t Issue a Permit Without a Survey First

A permit reviewer’s job is simple to describe and hard to fake: confirm the structure fits legally on the lot. They can’t do that from a sketch you drew on a napkin. They need a certified land survey tied to the actual property lines.

Arkansas doesn’t run permitting through one statewide office. Each city or county sets its own rules. Pulaski County handles submissions differently than Benton County. Washington County has its own review steps too. Some offices ask for a full boundary survey with every application. Others only require one for larger projects, like new construction or additions that push closer to the property line.

The common thread is this: no county wants to approve a project, only to find out later it crosses onto a neighbor’s land or violates a local ordinance. A survey protects the property owner as much as it protects the city.

Before you submit anything, call your local building or planning department. Ask directly what type of survey they require for your specific project. A five-minute phone call can save you weeks of back-and-forth later.

Setback Compliance: How the Survey Proves You’re Not Building Too Close to the Line

Every city and county sets setback rules. These are minimum distances a structure must sit from the front, side, and rear property lines. They exist to keep space between buildings, protect access for utility lines, and preserve some visual breathing room between neighbors.

A land survey shows exactly where those lines fall, down to the foot. Once your surveyor plots the proposed structure on the plat, a permit reviewer can measure the gap between your build and each boundary. If the numbers don’t meet local zoning requirements, the permit gets rejected until the plan changes or you request a variance.

This is where many projects run into trouble. Homeowners often estimate their property lines using a fence, a tree line, or an old plat from decades ago. None of those are reliable. Fences shift. Trees grow. Old surveys don’t account for later boundary adjustments. A current, accurate survey removes the guesswork and gives the reviewer something they can actually trust.

Elevation Data Your Permit Office May Pull From the Survey

Setbacks aren’t the only thing a reviewer checks. In parts of Arkansas near rivers, creeks, or low-lying ground, permit offices also look at elevation.

Specifically, they may want to know the finished floor elevation of your proposed structure compared to a base flood elevation set for that area. This isn’t the same as simply checking whether your lot sits inside a flood zone. It’s a more detailed measurement that shows how high the structure will actually sit once it’s built. 

Not every project needs this. It usually comes up in jurisdictions with stricter floodplain management rules, or on lots close to a mapped waterway. If your permit office asks for it, your surveyor can add this elevation data to the site survey. Skipping this step when it’s required is one of the most common reasons a permit gets sent back for revision.

When Your Permit Needs More Than a Basic Boundary Survey

A basic boundary survey works fine for straightforward projects. But some permit applications call for more detail.

Additions that extend closer to a property line often need updated measurements showing exactly how the new footprint relates to the boundary. Accessory structures like detached garages or workshops sometimes trigger the same requirement, especially if they sit near a rear or side setback.

Pools bring their own complications. Many jurisdictions require documentation showing the pool’s location relative to both property lines and any recorded easements. Fences near an easement raise similar questions, since utility companies often retain rights to access that strip of land regardless of what you build near it.

In these cases, a permit office may ask for what’s called an improvement location survey, or a more detailed site plan than a standard boundary sketch provides. If your project falls into any of these categories, ask your surveyor upfront whether a basic survey will satisfy the permit office, or whether you need something more thorough. It’s a faster question to ask before the work starts than after a rejection letter arrives.

What Happens If You Build Without Meeting Your Survey-Based Permit Conditions

Some property owners try to skip this step. They build first and hope nobody notices the setback is off by a few feet, or that the structure sits partly on an easement.

This rarely ends well. Inspectors do catch these issues, often during a routine inspection or when a neighbor files a complaint. Once flagged, the city can issue a stop-work order, which halts construction until the problem is resolved.

Depending on the violation, you may be required to move the structure, modify it, or in serious cases, remove it entirely. Fines are common too, and they add up the longer the violation sits unresolved.

The consequences don’t stop at construction. Unpermitted work or unresolved boundary violations often surface again at resale. Buyers’ lenders and title companies review permit history closely. A structure that was never brought into compliance can delay a sale, or kill it outright.

A land survey done early costs far less than fixing a mistake after the walls are up. It’s one of the few steps in a construction project where doing it right the first time genuinely saves both time and money down the road.
